Public Consultation

In terms of the NEMA EIA Regulations of 08 December 2014: GNR983, 984 and 985 promulgated under Chapter 5 of the National Environmental Management Act (as amended), Interested and Affected Parties (I&AP’s) must be identified for developments requiring environmental authorisation.

This website serves as a gateway for Engineering Advice and Services to facilitate this Public Participation Process for projects requiring Stakeholder Consultation. It provides Interested and Affected Parties (I&AP’s) and Stakeholders a forum to acquire project information regarding specific projects and also providing them with an opportunity to be involved in the environmental assessment process. I&AP’s may raise issues of concern they may have regarding the proposed development or activity. Project specific links for further information are provided, in various formats, as well as a link to register as an I&AP and to provide comments. Results of the process will be submitted to the relevant authority as part of the environmental authorisation application process (as a Comments and Responses report). 
BASIC ASSESSMENT PROCESS

The Basic Assessment Process consists of multiple phases, as depicted (indicated in the diagram »). The overall aim of this Consult BAR is to provide Organs of State and I&AP’s an opportunity to provide comment based on sufficient information for inclusion during the mandatory draft BAR phase.

The activities that will be conducted include:

Unregulated Timeframe

  • Advertisements of the development and placement of on-site posters, allowing I&AP’s to register;
  • Distribution of the Background Information Document (BID) to identified (I&AP’s), stakeholders and neighbouring residents;
  • Identification and undertaking of any specialist studies identified;
  • Distribution of a draft Consultation BAR for provisional comments to Organs of State;
  • Collation of I&AP comments on the BID and adverts, including responses to these issues into a Consultation BAR;
  • Submission of Application form to relevant authority; and

Regulated Timeframe

  • Preparation and distribution of the Consultation BAR for review by I&AP’s and distribution of an executive summary to all relevant Organs of State and I&AP’s registered for this project for a 30 day comment period. Electronic copies will be posted on the website;
  • Collation of I&AP comments on the Consult and draft BAR, and incorporation of these into the Final BAR; and
  • Submission of Final BAR to Department of Economic Development, Environmental Affairs and Tourism (DEDEAT) for a decision regarding authorisation.

The BAR submissions to the relevant authority include sections describing the biophysical & social environments, an assessment of potential impacts with mitigation measures and an Environmental Management Plan (EMP) for implementation. Part of the process includes a Public Participation Process (PPP) to facilitate social awareness of the project, and to provide I&AP’s with an opportunity to comment on the project specifics.
